Per Curiam: Steven Moxley appeals from the district court's order dismissing without prejudice his claim filed under 42 U.S.C. § 1983 (1988) but more properly brought under 28 U.S.C. § 2254 (1988). Our review of the record and the district court's opinion discloses that this appeal is without merit. Moxley failed to show that he exhausted his state remedies prior to bringing this action, as is required under 28 U.S.C. § 2254(b). Therefore, the district court properly dismissed the action. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
